1. Scope and roles
This Policy applies to personal information EMCO handles for its own websites, accounts, sales, support, security, and service operations. For customer-directed message recipients, EMCO may process information on behalf of the customer, and that customer's privacy notice also applies.
The organization deciding why and how a communication is sent is responsible for its recipient list, legal basis, content, and instructions. Contact the sender first for questions about a message you received.
2. Information you provide
We collect account details such as name, company, email address, phone number, password-derived security data, consent choices, and profile updates. We also collect information submitted through sales, support, contact, and subscription forms.
Customers may provide recipient identifiers, message content, templates, destination data, and other fields needed to deliver and support communications.
3. Information collected through use
We collect service events such as requests, timestamps, source site, channel, destination context, delivery state, cost context, errors, request identifiers, session activity, and security or audit events.
Web and application use can generate device, browser, approximate location, page path, referrer, cookie, and similar technical information. Where designed, network addresses may be truncated or transformed before analytics storage.
4. Sources of information
Information comes from users and customers, their applications, EMCO-connected sites, communications providers and carriers, security tools, service partners, and public or lawful business sources.
We may combine information from these sources when necessary to authenticate users, deliver communications, prevent misuse, resolve support issues, and maintain accurate service records.
5. How we use information
We use information to provide and route services; create and secure accounts; verify contact methods; process inquiries; operate support; measure delivery and usage; calculate charges; maintain content and settings; and communicate service changes.
We also use information to detect abuse and security incidents, comply with law, enforce agreements, improve reliability and usability, and send optional marketing where permitted by the user's choices.
6. Legal grounds and consent
Depending on location and context, processing may rely on performance of a contract, legitimate interests in operating and securing the service, compliance with legal obligations, protection of rights, or consent.
Where consent is used, it can be withdrawn for future processing. Withdrawal does not affect prior lawful processing and does not prevent necessary account, security, transactional, or service messages where another basis applies.
7. How we disclose information
We disclose information to communications carriers, email and messaging providers, cloud and security vendors, payment or professional advisers, and other processors only as needed to provide or protect the service.
We may disclose information to authorities or other parties when reasonably necessary to comply with law, protect people and rights, investigate abuse, enforce agreements, or complete a corporate transaction subject to appropriate safeguards. We do not sell personal information for money.
8. International transfers
Cross-border communications inherently involve processing in more than one country. Information may be handled where EMCO, customers, providers, carriers, or recipients operate.
Where required, we use contractual or other recognized safeguards for international transfers. Network routing can still require destination-local processing outside EMCO's direct control.
9. Retention
We retain information for as long as needed to provide the service, maintain security and audit trails, comply with financial or legal duties, resolve disputes, and enforce agreements. Retention periods vary by record type and customer instructions.
Account deletion may remove profile, session, credential, and consent records, while message, order, billing, abuse, or security records may be retained or de-identified where required for legitimate records and legal obligations.
10. Security
EMCO uses administrative, technical, and organizational measures designed to protect information, including access controls, credential separation, transport protection, logging, and revocable sessions.
No system is completely secure. Customers must protect their own credentials, use server-side secrets appropriately, limit access, and notify us promptly of suspected compromise.
11. Cookies and analytics
EMCO may use necessary cookies or similar storage for session, security, language, and preference functions. Optional analytics may help us understand page and product use.
Browser and device controls can limit cookies, but blocking necessary storage may affect sign-in or service functionality. We do not rely on hidden browser-language redirection when a locale has been explicitly selected.
12. Your choices and rights
Depending on applicable law, you may request access, correction, deletion, restriction, portability, or objection, and may withdraw consent or appeal certain decisions. We may verify identity and preserve information where an exception applies.
Account users can update certain profile and consent choices directly. Marketing messages should include an unsubscribe or preference method where required. Service and security messages may continue while an account remains active.
13. Children's information
EMCO services are intended for businesses and people able to form a valid contract, not for children. We do not knowingly collect personal information from children through account registration.
If you believe a child has provided personal information improperly, contact us so we can investigate and take appropriate action.
14. Customer-controlled communications
If you received a communication sent by an EMCO customer, that customer controls the purpose, recipient selection, and content. Direct opt-out, access, or deletion requests to the sender when possible.
EMCO may assist customers with valid requests and may investigate misuse under the Acceptable Use Policy, but we cannot alter another organization's records without appropriate authority and verification.
15. Changes and contact
We may update this Policy as services, laws, and practices change. We will show the updated date and provide additional notice of material changes when required.
